Welcome to LottoKim AI. These Terms of Service ("Terms") govern your access to and use of the LottoKim AI website and services (the "Service"). Please read them carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service

LottoKim AI provides AI-powered lottery number generation and analysis tools. The Service utilizes Large Language Models (LLMs) and historical data to provide users with potential lottery number combinations.

2. SERVICE NATURE AND NO GUARANTEE OF WINNING (CRITICAL DISCLAIMER)

PLEASE READ THIS SECTION CAREFULLY. BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

  • ENTERTAINMENT PURPOSES ONLY: The Service is provided for entertainment purposes only. It is a data analysis tool that filters and extracts combinations based on historical lottery data and Large Language Models (LLMs).
  • NO PURCHASE NECESSARY: While LottoKim AI offers paid subscriptions and credit top-ups for advanced features, the Service provides a free tier or complimentary initial credits. No purchase is strictly necessary to access basic features of the Service.
  • NO PROBABILITY ENHANCEMENT: The Service is NOT a "probability enhancement service." The mathematical odds of winning any lottery remain constant regardless of the use of our Service, AI, or statistical models.
  • NO GUARANTEE OF RESULTS: LottoKim AI does NOT guarantee, warrant, or represent that the numbers generated will result in a winning ticket, a prize, or any financial gain.
  • AI LIMITATIONS: AI models can produce hallucinations or incorrect data. You acknowledge that AI-generated suggestions are experimental and should not be relied upon for financial decisions.
  • USER RESPONSIBILITY: You are solely responsible for any decisions made or actions taken based on the information provided by the Service. Any purchase of lottery tickets is your independent choice and at your own financial risk.

3. LIMITATION OF LIABILITY AND INDEMNIFICATION

  • NO LIABILITY FOR LOSSES: To the maximum extent permitted by law, LottoKim AI, its owners, developers, and affiliates shall NOT be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to, damages for loss of money, expected profits, or any other financial losses resulting from the use or inability to use the Service.
  • FINAL RESPONSIBILITY: The final responsibility for any loss or failure to achieve expected results lies entirely with the user.
  • INDEMNIFICATION: You agree to indemnify and hold harmless LottoKim AI and its affiliates from any claims, suits, or actions arising from or related to your use of the Service or your violation of these Terms.

4. NO AFFILIATION WITH OFFICIAL LOTTERIES

LottoKim AI is an independent entity and is NOT affiliated with, endorsed by, authorized by, or sponsored by any official lottery organization, including but not limited to the Multi-State Lottery Association (MUSL), Powerball, Mega Millions, or any government-run lottery board. We do not sell lottery tickets, and we are not a lottery courier service.

5. Eligibility

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use this Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

6. User Accounts

Access to certain features requires you to log in via third-party social providers (e.g., Google, Apple). You are responsible for maintaining the security of your social media accounts and for all activities that occur under your LottoKim AI profile.

7. Payments, Credits, and Subscriptions

  • Credits: Certain AI models require "Credits" to generate numbers. Credits may be provided as part of a subscription or purchased as a "Top-up."
  • Subscriptions: LottoKim AI offers Monthly and Yearly subscription plans that grant access to specific features or a recurring set of credits.
  • Billing: All payments are processed securely through Stripe. By providing payment information, you authorize LottoKim AI to charge the applicable fees to your designated payment method.

8. CANCELLATION AND REFUND POLICY

PLEASE READ THIS SECTION CAREFULLY AS IT GOVERNS YOUR FINANCIAL OBLIGATIONS.

  • CANCELLATION: You may cancel your subscription at any time through your account settings. Cancellation does not result in an immediate termination of service. Upon cancellation, your access to the Service will continue until the end of your current paid billing cycle (Monthly or Yearly). No further charges will be applied after the expiration of the current cycle.
  • ALL SALES ARE FINAL: To the maximum extent permitted by applicable law, ALL PAYMENTS ARE NON-REFUNDABLE. We do not provide refunds or credits for any partially used subscription periods, unused credits, or mid-period cancellations. This "No Refund" policy applies to both Monthly and Yearly subscription plans.
  • ANNUAL PLANS: For Yearly subscriptions, if you choose to cancel before the end of the 12-month term, you will not receive a prorated refund for the remaining months. Your access will remain active until the end of the 12-month period you paid for.
  • EXCEPTIONS: We reserve the right, in our sole and absolute discretion, to issue refunds or credits in exceptional circumstances (e.g., to comply with specific local laws or to resolve technical errors on our part). The issuance of a refund in one instance does not entitle you to a refund in the future, nor does it obligate us to provide refunds in similar cases.
  • SERVICE MODIFICATIONS: LottoKim AI reserves the right to change its pricing, subscription plans, features, or AI models at any time. Any price changes will be communicated to you in advance and will apply to the next billing cycle.

9. Data Retention

  • The Service allows you to save generated numbers (up to a limit, e.g., 200).
  • We reserve the right to delete older records if you exceed the storage limit or if your account remains inactive for an extended period.

10. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose.
  • Attempt to reverse engineer, scrape, or exploit the AI models or data.
  • Use automated systems (bots) to access the Service without our express permission.

11. WARRANTY DISCLAIMER (THE "AS IS" CLAUSE)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. LOTTOKIM AI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LOTTOKIM AI MAKES NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS; (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE (INCLUDING GENERATED NUMBERS) WILL BE ACCURATE, RELIABLE, OR RESULT IN ANY PRIZE OR WINNINGS.

12. LIMITATION OF LIABILITY

IN NO EVENT SHALL LOTTOKIM AI, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (I) THE USE OR THE INABILITY TO USE THE SERVICE; (II) ANY FINANCIAL LOSSES FROM LOTTERY TICKET PURCHASES; OR (III) ANY ERRORS OR HALLUCINATIONS PRODUCED BY THE AI MODELS.

13. DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.

  • BINDING ARBITRATION: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be determined by binding arbitration rather than in court. There is no judge or jury in arbitration, and court review of an arbitration award is limited.
  • CLASS ACTION WAIVER: YOU AND LOTTOKIM AI AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. This means you cannot bring a claim as a plaintiff or a class member in a class action or any other representative proceeding.

14. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware (or applicable jurisdiction depending on your legal entity's location), without regard to its conflict of law provisions. For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in the chosen jurisdiction.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Service. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
